POCSO bail Fake Age Certificate News
Advocate RAVI DRALL got anticipatory bail of his client who was being harrased by police upon submitting an alleged fake birth certificate for declaration of her son Juvenile in a POCSO case before the Ld. Sessions Judge, Rohini, Court, Delhi.
Police can’t detain and illegally arrest without giving notice to accused where provisions of Sec. 41 Cr.PC are mandatory to be followed. Sec 41 CrPC was amendment to CrPC (Criminal Procedure Code) in 2010 to minimize abuse of powers of arrest by police in the cases which are punishable upto 7 years.
Police officials were visiting accused at odd hours and detained other family members in police station Sultanpuri. FIR was lodged in year 2016 but arrest proceedings started after a long gap of more than 2 years reason best known to IO.
